Three men have been charged with threatening a Dublin publican to stop trading.
Alan Ryan (30) of Grange Abbey Drive, Donaghmede, Daryl Mulcahy (20) with an address at Matt Talbot Court and Derek Nolan (29), from Seacliff Road, in Baldoyle appeared in Dublin District Court today.
They were charged under Section 17 of the Public Order Act with making a demand with menaces to Shane Simpson, the former lease holder of the Castle public house, in Summerhill in the north inner city on March 13th.
Their charges also state that this was to “gain for yourself or another” or “to cause loss to another made an unwarranted demand, to cease trading in the Castle Public House and close within 24 hours”.
Gda Elaine O’Malley told Judge David McHugh at Dublin District Court that she arrested Mr Ryan at 7.41am yesterday and he was taken to Store Street station. He made no reply after the charge was put to him at 6.33pm.
She had no objection to bail providing conditions were attached.
Gda Damien Kildea told Judge McHugh that Mr Mulcahy made no reply to the charge after caution. He also asked for similar bail conditions to be imposed on Mr Mulcahy.
Gda Peter Hughes told Judge McHugh that Mr Nolan made no reply when he was charged yesterday evening and he also asked the court to set bail conditions.
Judge McHugh granted bail and ordered the three accused to stay away from Shane Simpson as well as his brother Stephen Simpson and staff from the Castle pub, not to associate with each other and sign on daily at their local Garda stations.
The locations of the Garda stations were not read out in court, at the request of defence solicitor Michael Finucane, and were furnished to the judge in writing.
Mr Ryan and Mr Nolan were also banned, as conditions of bail, from going to the Dublin 1 and Dublin 3 areas. Mr Mulcahy was ordered to stay out of the Dublin 1 area only and told he must notify gardaí if he intended to change his address.
The three men, who were not required to speak during today's brief hearing, were each remanded on bail in their on own bond of €500, to appear again on June 24th next.
